Noise and Fireworks Rules

This resolution was passed August 16th, 2000 and outlines the regulations against fireworks, airplane and helicopters flown over the zoo, and other loud noises that occur near the zoo.

INDIANA WHITE RIVER STATE PARK DEVELOPMENT COMMISSION
Resolution With Respect to Fireworks and Other Unusual Noises

WHEREAS, the Indiana White River State Park Development Commission (the “Commission”) is the owner of certain real estate located within the White River State Park (the “Park”) in Indianapolis, Indiana; and

WHEREAS, the Indianapolis Zoological Society, which operates the Indianapolis Zoo (the “Zoo”), is one of the tenants which conducts operations within the Park; and

WHEREAS, the Zoo has informed the Commission of the potential danger and disturbance to the animal inhabitants and guests of the Zoo from the noise associated with, among other things, fireworks, loud speakers and demolition activities which may occur near the Zoo, airplanes and helicopters which fly over the Zoo, and helium balloons which may fall into the premises comprising the Zoo; and

WHEREAS, the Commission desires to implement guidelines for the protection of the animal inhabitants and guests of the Zoo from the above-referenced potential dangers;

NOW, THEREFORE, be it resolved by the Indiana White River State Park Development Commission as follows:

(1) The Executive Director of the Commission is hereby authorized, for and on behalf of and in the name of the Commission, to develop guidelines which, among other things, require that any Tenant of the Park or any other third party who desires to (i) use any portion of the Park for activities associated with fireworks, loud speakers, demolition of buildings or other activities which will generate unusual noise, (ii) fly airplanes and helicopters over the Zoo other than in the ordinary course of regularly scheduled air traffic, or (iii) launch helium balloons, confetti or other similar flying objects from the Park, to first consult with and obtain the approval of an authorized representative of the Zoo to conduct such activity. The guidelines should further provide that such approval of the Zoo must be obtained in writing before the Commission will approve the conducting of such activity. The Executive Director is further authorized to develop such additional or modified guidelines governing such activities as the Executive Director, in her/his sole discretion, deems appropriate.
